1. Introduction

This Privacy Policy explains how Lumitech FZCO (“Lumitech”, “we”, “us”, “our”), the operator of the Tolmete platform (“Tolmete”, the “Services”), collects, uses, shares, and protects personal data. It also explains the rights available to individuals under the EU General Data Protection Regulation 2016/679 (“GDPR”), the UK GDPR, and equivalent applicable data protection laws.

We are committed to processing personal data lawfully, fairly, and transparently. If you have any questions about this Policy or about how your personal data is handled, please contact us at legal@tolmete.com.

2. Scope of This Policy and Our Role

This Policy applies to personal data we process about: (a) visitors to our website at tolmete.com; (b) individuals who register for and use a Tolmete account; and (c) representatives of organisations that subscribe to the Services.

2.1 Where we act as a controller

We act as a data “controller” — meaning we determine the purposes and means of processing — in respect of: website visitor data, account registration and authentication data, organisation profile data, billing and subscription data, and our direct communications with you (for example, support and product updates). This Policy governs that processing.

2.2 Where we act as a processor

When a customer organisation uses Tolmete to record time logs, generate summaries and Signals, share data through the Client Portal, or create invoices, we process the personal data contained in that workspace on behalf of, and under the instructions of, the customer organisation. In that context the customer organisation is the controller and Lumitech is the “processor”. That processing is governed by our Data Processing Agreement (DPA) rather than by this Policy.

If you are an employee, contractor, or end-client of an organisation that uses Tolmete and you have questions about how your personal data is used in that organisation’s workspace, please contact that organisation in the first instance, as it is the controller of that data. We will support the organisation in responding to your request.

3. Personal Data We Collect

We collect the categories of personal data described below. Where we act as a processor (Section 2.2), the categories of data and data subjects are set out in Annex A to the DPA.

We do not sell personal data, and we do not use it for advertising profiling.

5. AI and Automated Processing

Tolmete uses automated processing to generate the following outputs:

AI Summaries — project, activity, and contributor-level summaries generated from time log data;

Signals — insights, hypotheses, anomalies, and AI-generated mitigation plans based on connected-source data and time logs; mitigation plans may reference named contributors and recommend actions for specific team members;

Activity mapping — automated suggestions mapping invoice activities from Zoho / QuickBooks to Tolmete activities, subject to human review and approval.

We do not use automated processing to make decisions that produce legal effects or similarly significant effects on individuals within the meaning of Article 22 GDPR. AI-generated outputs are informational and are presented to authorised users for review, confirmation, or rejection. Where an organisation uses these outputs, it is responsible for applying appropriate human oversight before relying on them for any decision affecting an individual, including employment-related decisions.

Time log and connected-integration data sent to our AI sub-processor for processing is covered by a data processing agreement. Where a connected chat integration has the relevant setting enabled, short excerpts of channel messages (up to 280 characters each) may be included in that processing. API-submitted data is not used to train the provider’s models, and a zero-data-retention configuration is applied where available.

6. Cookies and Similar Technologies

We use cookies and similar technologies on our website for two purposes:

  • Strictly-necessary cookies, which are required to operate the site and keep you signed in. These are always active and do not require consent.
  • Analytics cookies, which help us understand how the website and Services are used so we can improve them. These are set only where permitted and, in the EEA and UK, with your consent.

You can manage non-essential cookies through our cookie controls and through your browser settings. Withdrawing consent does not affect the lawfulness of processing carried out before withdrawal. The specific cookies in use may be updated from time to time; please refer to our cookie controls for the current list.

7. Who We Share Personal Data With (Sub-processors)

We share personal data with the service providers (“sub-processors”) listed below, who process it on our behalf to help deliver the Services. We impose data protection obligations on each sub-processor equivalent to those we are subject to, and we remain responsible for their performance. “Limited” indicates that the provider may receive technical or metadata incidentally (for example, error logs or API call data) but is not engaged to process the content of personal data as its primary function.

We may also disclose personal data where required by law, to enforce our agreements, or to protect the rights, safety, and property of our users or others. If we are involved in a merger, acquisition, or asset sale, personal data may be transferred subject to this Policy.

8. International Data Transfers

Our primary infrastructure is hosted on Google Cloud Platform servers located in the European Union, and all data at rest is stored within the EU.

Some processing involves sub-processors located outside the European Economic Area (EEA), including in the United States, and Lumitech FZCO itself is established in the United Arab Emirates, which has not received an EU adequacy decision. Where personal data is transferred outside the EEA, we rely on the European Commission’s Standard Contractual Clauses (Decision 2021/914) or an equivalent valid transfer mechanism, together with appropriate supplementary measures. You may request further information about these safeguards using the contact details in Section 13.

9. Data Retention

We retain personal data only for as long as necessary for the purposes described in this Policy, after which it is deleted or anonymised. Key retention periods are:

Data
Account identifiers (name, email, avatar, location, job title, timezone)
Retention period
Retained until a deletion request. On confirmed deletion, the full name is replaced with “Deleted User” immediately, and remaining personal identifiers are permanently deleted within 30 days.

10. Your Rights

Subject to applicable law, you have the following rights in relation to your personal data:

  • Access — to obtain confirmation of, and a copy of, the personal data we hold about you;
  • Rectification — to have inaccurate or incomplete personal data corrected;
  • Erasure — to have your personal data deleted in certain circumstances;
  • Restriction — to limit how we process your personal data in certain circumstances;
  • Portability — to receive your personal data in a structured, commonly used, machine-readable format where technically feasible;
  • Objection — to object to processing based on our legitimate interests;
  • Withdraw consent — where processing is based on consent, at any time, without affecting prior processing;
  • Complain — to lodge a complaint with a supervisory authority (see Section 12).

10.1 How to exercise your rights

To request access, a data export, or correction of your data, or to ask a general privacy question, contact legal@tolmete.com. Requests for deletion of a personal account should be sent to support@tolmete.com from the email address registered on the Tolmete account and should include your full name and the approximate date of your last login. We will confirm receipt and respond within 30 calendar days.

If your personal data is held within an organisation’s workspace where we act as processor, we will forward your request to that organisation, as controller, and assist it in responding.

10.2 Account deletion and an important limitation on time logs

On confirmed deletion of a personal account, the full name is replaced with “Deleted User” immediately, and all remaining personal identifiers (email address, avatar, location, job title, timezone) are permanently deleted within 30 calendar days. Individual time logs cannot be deleted on a standalone basis, because they form part of the organisation’s project and financial records; they are attributed to “Deleted User” and are permanently deleted only as part of a full Organisation account deletion. A Super Admin can initiate deletion of an entire Organisation account, subject to a 30-day recovery window followed by permanent deletion within a further 30 days.

11. How We Protect Personal Data

We maintain technical and organisational measures appropriate to the risk, including:

  • Encryption in transit using TLS 1.2 or higher, and encryption at rest using AES-256 on Google Cloud Platform infrastructure;
  • Role-based access control, with access to production systems and key sub-processor accounts restricted to authorised personnel;
  • Strong password policies and multi-factor authentication for administrative access to production systems;
  • Network security via Google Cloud VPC with firewall rules and regular security patching;
  • Data minimisation — only data necessary for the relevant purpose is collected and transmitted to AI sub-processors; Slack / Teams data is limited to the channels an administrator has linked to a project, and to private channels only where the Tolmete bot has been added; one-to-one direct messages are never collected;
  • Application monitoring and logging, reviewed for security incidents;
  • Confidentiality obligations binding personnel with access to personal data, and a documented data breach response procedure.

If a personal data breach occurs that affects your personal data, we will act in accordance with our legal obligations, including notifying the relevant controller and, where required, the competent supervisory authority and affected individuals.

12. Complaints and Supervisory Authorities

If you are located in the EEA or the UK, you have the right to lodge a complaint with the data protection supervisory authority in your country of residence, place of work, or the place of an alleged infringement. We would, however, appreciate the opportunity to address your concerns directly before you contact a supervisory authority — please reach us at legal@tolmete.com.

13. EU Representative

As Lumitech FZCO is established outside the European Union, we have designated a representative in the Union under Article 27 GDPR. EEA-based individuals and supervisory authorities may contact our EU Representative on matters relating to the processing of personal data under this Policy:
